Terms of Service - LCMedia.ai (Third-Party Messaging Consent)

These Terms of Service ("Terms") govern the use of the LCMedia.ai platform by clients ("Clients") who may communicate with third-party end users ("End Users") through voice agents, SMS, or other messaging channels. LCMedia.ai is a product of LCMediaGroup ("we", "our").

By using LCMedia.ai, Clients agree to the following:

1. Use of the Service

LCMedia.ai provides tools to integrate AI-powered voice agents for communication over phone and web, including SMS and voice-based interactions with End Users. Clients may use the platform to facilitate communications such as notifications, confirmations, and customer support.

2. Responsibility for End User Consent

Clients are solely responsible for obtaining valid and verifiable consent from their End Users prior to initiating any communication through LCMedia.ai, including:

  • - SMS notifications
  • - Automated or pre-recorded voice calls
  • - Other phone-based interactions

This includes:

  • - Providing clear disclosure of message purpose, frequency, carrier fees, and opt-out methods (e.g. "Reply STOP to opt out")
  • - Capturing the date, method, and source of consent
  • - Storing and making available this information upon request for audits or legal inquiries

LCMedia.ai reserves the right to request proof of consent for any number submitted through the platform.

3. Submission of Contacts

Clients who upload or submit End User contact information (e.g. phone numbers) via API, dashboard, or form must also provide associated metadata such as:

  • - Consent type (e.g., "web_form", "verbal")
  • - Consent source (e.g., website URL or system reference)
  • - Timestamp of consent

Any contact without verifiable consent metadata may be rejected or flagged.

4. Compliance and Legal Requirements

Clients agree to comply with all applicable laws and industry regulations, including:

  • - The Telephone Consumer Protection Act (TCPA)
  • - CAN-SPAM
  • - A2P 10DLC compliance requirement
  • - Local and international data privacy laws (e.g., GDPR, CCPA, as applicable)

LCMedia.ai provides tooling but does not assume legal liability for client misuse or lack of user consent.

5. Data Storage and Retention

Clients must ensure that all consent records are stored securely and retained for at least 6 months or the period defined by law. LCMedia.ai may store submitted metadata for compliance purposes but does not verify its validity in real time.

6. Prohibited Use

Clients shall not:

  • - Use LCMedia.ai to send messages to users who have not given explicit consent
  • - Mislead users about who is contacting them
  • - Send marketing/promotional content unless prior consent was obtained

Violations may result in account suspension or legal action

7. Audit and Suspension

LCMedia.ai reserves the right to:

  • - Audit campaign activity
  • - Request evidence of opt-in consent
  • - Suspend or restrict messaging activity if violations or complaints occur

8. Limitation of Liability

LCMedia.ai shall not be held responsible for legal disputes, fines, or penalties arising from Client failure to properly obtain or document End User consent.

9. Governing Law

These Terms are governed by the laws of the State of New York, United States.

11. Opt-Out Requests

Client agrees to honor user opt-out requests submitted via SMS keywords such as STOP or UNSUBSCRIBE. LCMedia.ai will enforce these blocks at the platform level. Clients may not override this behavior unless a new, verifiable opt-in is collected.
